IV Plenary Council; 1937 (4th - 12th September)

 

At the insistence of the Holy See, this council was held from 4 until 12 September 1937. Its purpose was to bring Australian canonical legislation into harmony with the 1917 Code of Canon Law. The New Zealand bishops, who had been refused permission to attend the councils of 1895 and 1905, were summoned to this council and advised that, as New Zealand had the same language and customs as Australia, it was advantageous it share the same ecclesiastical discipline. An apostolic delegation had been established for the two nations in 1914 with its seat in Sydney, and the Apostolic Delegate in 1937, Archbishop Giovanni Panico, was appointed legate to preside over the Council. To the dismay of the bishops, unlike the previous councils, the agenda, the procedure and the drafting of the legislation was entirely controlled by the apostolic delegation. At the council, the thirty-three council fathers (Archbishops Giovanni Panico [tit. abp Justiniana, Apostolic Delegate], Michael Kelly [Sydney], James Duhig [Brisbane], Daniel Mannix [Melbourne], Thomas O’Shea SM ([Wellington], Andrew Killian [Adelaide], Redmond Garrett Prendiville [Perth], Justin Daniel Simonds [Hobart], Norman Thomas Gilroy [tit. abp Cypsela, coadjutor Sydney]; Bishops John Joseph Carroll [Lismore], John Alphonsus Heavey OSA [tit. bp Coracasium, vicar apostolic Cooktown], Matthew Joseph Brodie [Christchurch], Daniel Foley [Ballarat], John McCarthy [Sandhurst], Joseph Wilfred Dwyer [Wagga Wagga], James Michael Liston [Auckland], James Whyte [Dunedin], Richard Ryan CM [Sale], John Barry [Goulburn], John Francis Norton [Bathurst], James Byrne [Toowoomba], John Aloysius Coleman [Armidale], Edmund John Aloysius Gleeson CSSR [Maitland], James Patrick O’Collins [Geraldton], Terence Bernard McGuire [Townsville], Patrick Joseph Farrelly [tit. bp Neve, coadjutor Lismore], Thomas Martin Fox [Wilcannia-Forbes], Romuald Denis Hayes SSC [Rockhampton], Otto Raible SAC [tit. bp Anemurium, vicar apostolic Kimberley], Francis Augustin Henschke [tit. bp Prænetus, auxiliary Wagga Wagga]; Abbot Nullius Anselm Maria Catalán OSB [New Norcia]; Revv. Francis-Xavier Gsell MSC [apostolic administrator Victoria & Palmerston], Michael Brendan Clune [diocesan administrator Port Augusta]) - assisted by fifty-three priests - merely had to approve what was placed before them. They complied, except for abolishing their previously granted privileges for fasting and holy days. One quarter of the 685 decrees was simply a rehearsal of the Code of Canon Law (much of it verbatim), and all previous conciliar legislation (including the participation of priests in the selection of bishops) was abrogated.
